Federal Motor Carrier Safety Administration Regulations apply to Semi-truck or tractor trailer crashes or accidents. If the crash is caused by a faulty truck condition, see FMCSAR 369.7. If the crash is caused by a faulty tire, see FMCSAR 393.75 and 397.17. Brown and Szaller successfully handled a wrongful death when a driver had to swerve to avoid a retread tire which had blown but appeared to be a full size truck tire.

§396.7 Unsafe operations forbidden.

(a) General — A motor vehicle shall not be operated in such a condition as to likely cause an accident or a breakdown of the vehicle.

§393.75 Tires.

(a) No motor vehicle shall be operated on any tire that (1) has body ply or belt material exposed through the tread or sidewall,

(2) has any tread or sidewall separation,

(3) is flat or has an audible leak, or

(4) has a cut to the extent that the ply or belt material is exposed

§397.17 Tires.

(a) A driver must examine each tire on a motor vehicle at the beginning of each trip and each time the vehicle is parked.

(b) If, as the result of an examination pursuant to paragraph (a) of this section, or otherwise, a tire is found to be flat, leaking, or improperly inflated, the driver must cause the tire to be repaired, replaced, or properly inflated before the vehicle is driven…
